Land registration is any of various systems by which matters concerning ownership, possession, or other rights in land are formally recorded to provide evidence of title, facilitate transactions, and prevent unlawful disposal. Land registration is the mechanism used by many governments to record and establish the ownership of land. Regional statutes govern how land titles are to be registered, which may include the designated government agency providing the landowner with a certificate.
The Department is responsible for issuance of certificates of titles, general conveyance, keeping custody of the national land register, coordination, inspection, monitoring and back-up technical support relating to land registration and acquisition processes to local governments. Land registration is the procedure of official documentation of rights in land through deeds or title on the interest in land. This connotes an official record (the land register) of right on land or deed of changes in the legal state.
Advantages Of Land Registration In Uganda
The main objects of land title registration are to protect property rights, to facilitate transactions in land, and to enable land to be used as collateral for a loan. Registered land offers more protection against property fraud. The Land Registry requires confirmation of identity before registering a transfer of property. It may notify you of certain applications against your title to check that they are genuine.
Registered land has many advantages over its unregistered counterpart, including: Ownership, & matters affecting the title, are clearer and more certain. Conveyancing registered land is usually quicker and more straightforward. Increasingly, buyers expect land to be registered before proceeding with a transaction.
Land registration helps you to protect your land from fraud and to resist third party applications for adverse possession (“squatter’s rights”) over your land and property. It also safeguards against the title deeds being lost, damaged or destroyed.
Cost Of Land Registration In Uganda
Fees paid at the Ministry – Registration fees – 10,000; Assurance of Title – 20,000 UGX; issuance of the Title – 20,000 UGX.
Procedures For Land Registration In Uganda
The first step is to make an application directed to the Uganda state director of the Land Services and Land Directorate.
The Land Form 1c which must be duly signed by the parties to the transaction and sworn to before a magistrate or perhaps notary public.
