Legal Aid Services In Uganda

Legal aid is the provision of legal assistance to the poor, vulnerable and marginalized in society. Legal aid is given in form of court representation, legal counseling and advice and sensitization on the laws and rights which is done through simplification of laws, radio programmes and community outreach programmes.

Free legal aid is the provision of free legal services in civil and criminal matters for those poor and marginalized people who cannot afford the services of a lawyer for the conduct of a case or a legal proceeding in any Court, Tribunal or Authority. Legal aid is the provision of assistance to people who are unable to afford legal representation and access to the court system. Legal aid is regarded as central in providing access to justice by ensuring equality before the law, the right to counsel and the right to a fair trial.

Legal aid lawyers should refer to the Office of the Permanent Secretary within the Ministry for Home Affairs, National Security and Law Enforcement. For those that cannot afford a lawyer, access to legal advice and assistance can not only empower a person to resolve their legal problem, but also to prevent that problem from negatively impacting the other facets of their life. Legal aid will pay towards the rates or fixed fees of a solicitor for your case. There are different types of legal aid: Legal Help – a solicitor can advise you and negotiate with the other party but cannot represent at court.

The Government provides money to help pay for your case. The money comes from the Community Legal Services Fund (CLS) and is administered by the Legal Aid Agency. You may be entitled to legal aid just to speak to a solicitor and to have a solicitor write letters on your behalf, this is known as Legal Help. In order to qualify for free legal advice and assistance (‘legal aid’) your case needs to satisfy both a merits and a means test. The merits test requires that your case has some clear benefit to you or some other person. The means test is more complicated. Both your income and your capital must be assessed.

Cost Of Legal Aid Services In Uganda

Legal Aid will fund all costs related to your case, including the costs of legal advice, representation, evidence gathering and court fees. It will also pay the other party’s costs if you lose. However, depending on their income and savings, some people will be asked to contribute towards their legal costs.
